Abstract
This study examines the legal regulation of the enforcement of criminal judgments under Qatari legislation. It aims to establish the legal framework governing the stage of criminal enforcement and to clarify its nature, procedures, and guarantees. The study adopts a descriptive-analytical approach by reviewing and analyzing the legal provisions regulating criminal enforcement in the State of Qatar, with reference to criminal jurisprudence where required by the academic context.
The study explores the concept of criminal enforcement as the practical effect of an enforceable judicial instrument, and identifies the cases in which judgments are enforced provisionally, whether mandatorily or permissibly, as well as cases in which enforcement may be postponed in consideration of humanitarian and social factors. It further addresses the procedures for enforcing principal penalties, beginning with the death penalty, followed by custodial penalties, and ending with community service, in addition to the enforcement of accessory penalties. The study also discusses the guarantees afforded to convicted persons during enforcement, most notably the right to appeal, the suitability of the enforcement method to the individual and humanitarian circumstances of the offender, judicial supervision over enforcement within penal and correctional institutions, and the possibility of raising enforcement disputes to temporarily or permanently suspend enforcement.
The study reaches several key findings, most notably that the Qatari legislator has established an advanced legislative framework for criminal enforcement grounded in the principles of Islamic Sharia, justice, and human rights, through an integrated legislative system. It also concludes that criminal enforcement under Qatari law possesses a dual legal nature, combining both administrative and judicial functions. In light of these findings, the study recommends the establishment of a judge specialized in criminal enforcement to enhance sentence individualization and achieve rehabilitation and reform objectives, as well as the amendment of Article (57) of the Qatari Penal Code to explicitly clarify the principal penalties related to hudud, qisas, and diyah crimes, in order to ensure legislative clarity and coherence in the legal structure.
